Michael Michael Magliarihas been practicing law since 1983 with an emphasis in estate planning, probate, trust and tax law.  Michael was the managing partner of Briegel, Baylard, P.C., from 1996 until 1999.  He is currently the managing partner of Michael E. Magliari, P.C., founded in 1999.

Michael has extensive experience and expertise in the drafting of wills, trust instruments, durable powers of attorney, marital agreements, and other estate planning documents; buy-sell and restrictive stock agreements; pre-death and post-death tax planning for individuals, trusts, and estates; and representation of individual fiduciaries.  In addition, Michael has been a frequent lecturer and estate planning counsel for numerous charitable organizations, insurance companies, investment firms and trust companies throughout St. Louis and the surrounding areas.

Michael has been a member of the Missouri Bar since September 17, 1983.  He is the founding chairman of the Missouri Bar Association Estate Planning Division (2015-2018) and former chairman of the Missouri Bar Association Trust and Probate Committee (2014-2016).  Michael is currently serving as the chairman of the Missouri Bar Association Trust Revision Subcommittee (2008-2022).  In addition, he is a former member of the Ethics Committee of the Bar Association of Metropolitan St. Louis (1985-1988).  Michael also served on the Missouri Director of Revenue’s Estate Tax Advisory Council under Director Quinton Wilson (1998-2002).

As the former chairman of the Missouri Bar’s Trust and Probate Committee and Estate Planning Division, Michael played a significant role in the drafting and enactment of several pieces of legislature in Missouri, having presented the legislation to the Senate and House Judiciary Committees on behalf of the Missouri Bar.  The legislation includes the Missouri Qualified Spousal Trust statute, the Decanting statute, the Trust Protector statute, the Principal and Income statute, the Power of Appointment statute, the Trustee Removal statute, and the Revised Fiduciary Access to Digital Assets statute.

Michael has authored and coauthored numerous books and other publications concerning the estate planning process.  Some of those include the Missouri Bar Association’s Probate Law Resource Guide in 2015, “The Trust Administration Chapter” in the Missouri Bar Association’s Desk Book Series in 2006, including the supplement in 2010 and 2013 “Estate Planning:  The Fundamental Concepts Under Missouri Law” in 2011, and edited the Qualified Spousal Trust chapter in the Missouri Probate Law Resource Guide in 2022.
